Terms and Conditions – AQuaHosting

1. Definitions

• AQuaHosting: The company providing game server hosting services to private customers in the Netherlands.
• Customer: A natural person using AQuaHosting’s services for non-commercial purposes.
• Services: The provisioning of virtual game servers for games such as Minecraft, FiveM, 7 Days to Die, Satisfactory, Conan Exiles, and others.
• Agreement: Any agreement between AQuaHosting and the Customer regarding the use of services.

2. Applicability

These terms and conditions apply to all offers and agreements between AQuaHosting and the Customer, unless explicitly agreed otherwise in writing.

3. Services

3.1 Upon successful payment, the Customer’s game server is automatically provisioned and activated.
 3.2 AQuaHosting aims to maintain a 99.9% monthly uptime. In the event of scheduled maintenance, Customers will be notified in advance.

4. Customer Responsibilities

4.1 The Customer is responsible for the proper and legal use of their game server.
 4.2 It is strictly prohibited to:

• Conduct or facilitate DDoS attacks;
• Host illegal or copyrighted content without permission;
• Distribute malware or harmful software;
• Violate the rights of third parties;
• Use game exploits or hacks that overload the system.

4.3 AQuaHosting reserves the right to suspend or terminate any server or account violating these rules.

5. Modding & Restrictions

5.1 Customers may install mods as long as they do not negatively impact platform stability or other users.
 5.2 AQuaHosting does not provide support for third-party or experimental mods. Any issues caused by mods are not covered under warranties or SLAs.

6. Payment

6.1 Payment must be made in advance through the available payment methods provided by AQuaHosting.
 6.2 If payment is not made, the server will be deactivated until payment has been made.
 6.3 After 7 days of non-payment, the server and all associated data may be permanently deleted.

7. Withdrawal and Refunds

7.1 Due to the digital nature of the services and immediate provisioning upon request, the legal right of withdrawal is excluded.
 7.2 AQuaHosting does not offer refunds unless explicitly agreed upon in writing.

8. Liability

8.1 AQuaHosting is not liable for any direct or indirect damages, including data loss, loss of profits, or hardware damage, unless caused by gross negligence or intentional misconduct.
 8.2 AQuaHosting is not responsible for damages resulting from external events such as DDoS attacks or failures at upstream providers.

9. Maintenance and Changes

9.1 AQuaHosting may perform maintenance on its systems, during which services may be temporarily unavailable.
 9.2 AQuaHosting reserves the right to amend these terms and conditions. Customers will be informed at least 14 days in advance of any changes.
